Welcome to PhotoAssist ("we", "our", or "us"). These Terms of Service govern your use of the PhotoAssist website at photoassist.co.uk (the "Service"), a platform connecting photographers with photo assistants and digital technicians in the United Kingdom.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised use of your account

4. User Types

The Service supports two types of users:

• Assistants: Photo assistants and digital technicians who create profiles to be discovered by photographers
• Photographers: Photography professionals who search for and contact assistants

5. Assistant Profiles

If you register as an assistant, you agree that:

• Your profile information will be publicly visible to all users
• You will only include accurate information about your skills and experience
• You are responsible for the content you upload, including portfolio images
• You will not upload content that infringes on others' intellectual property rights

6. Profile Visibility and Analytics

When you view assistant profiles while logged in as a photographer, your name and company may be visible to Premium members through our profile analytics feature. If you prefer to browse anonymously, you may do so while logged out.

7. Premium Subscriptions

We offer Premium subscriptions for assistants with additional features. By subscribing:

• You authorise us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel at any time through your account settings or the Stripe customer portal
• Refunds are provided in accordance with applicable consumer protection laws

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use automated systems to access the Service without permission
• Collect or harvest user data without consent
• Use the Service to send spam or unsolicited communications

9. Content Ownership

You retain ownership of content you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with the Service.

10. Disclaimer

PhotoAssist is a platform that facilitates connections between photographers and assistants. We do not:

• Employ or represent any assistants listed on the platform
• Guarantee the accuracy of user-provided information
• Verify the qualifications or background of users
• Take responsibility for any agreements made between users

Users are responsible for conducting their own due diligence before entering into any working arrangements.

11. Limitation of Liability

To the fullest extent permitted by law, PhotoAssist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
